USDOS Announces Special Priority Date Schedule For October

For October, the State Department has announced a different approach regarding priority dates and an individual’s ability to file for adjustment of status.  As a result, eligibility to file an I-485 application for adjustment of status in October is as follows:

EB-1 remains current for all countries.

EB-2 China advances by more than 8 years to May 1, 2014.

EB-2 India advances by more than 5 years to July 1, 2011.

EB-2 remains current for all other countries.

EB-3 China advances by nearly 9 years to October 1, 2013.

EB-3 India advances by more than 6 months to July 1, 2005.

EB-3 Philippines advances by more than 10 years to January 1, 2015.

EB-3 advances one month to September 1, 2015 for all other countries.

A large number of I-485 filings are expected during the month of October and will likely result in retrogression of priority dates for November and several months beyond.
