The U.S. Department of State has announced that the annual limit for the EB-1 and EB-3 visa categories has been reached. These categories determine when a green card applicant can apply for Adjustment of Status as a part of their green card process. Reaching the annual limit means that the number of EB-1 and EB-3 visas allocated for the current fiscal year has been exhausted.
What Does It Mean That the Annual Limit Has Been Reached?
Impact on Applicants With Currently Pending Form I-485s: If you have a currently pending Form I-485 under the EB-1 or EB-3 category, this news may impact your application timeline. With the annual cap reached, new applications will be subject to a waiting period until the next fiscal year begins. If your priority date is current for the month of September, you may still file your Form I-485 but it will not be approved until the new fiscal year begins. The federal fiscal year restarts on October 1, 2024, so there is not long to wait before an entire new slate of visa openings will be available.
